These Terms and Conditions ("Agreement") detail the conditional use of TimberQuote services and the TimberQuote.com website. Any questions regarding the contents of this Agreement should be directed to info@timberquote.com . This Agreement may be amended from time to time without prior notice. All notices and other communications required or permitted under this Agreement shall be deemed given when posted to the website. Access to the TimberQuote website or utilization of any TimberQuote service signifies your acceptance of this Agreement.
ABOUT TIMBERQUOTE. TimberQuote LLC ("TimberQuote") provides a searchable online database to connect timberland owners to service providers, forestry related educational information, and other tools and services to help timberland owners and forestry professionals succeed. Registration is required for timberland owners prior to searching for service providers. Registration and Membership are required for service providers to be included in the database and gain access to other valuable TimberQuote services.
TIMBERQUOTE SERVICES. TimberQuote is committed to making TimberQuote.com the preferred site for forestry solutions. TimberQuote strives to provide enough information and tools (in a format that is easy to understand) to help users succeed. This includes educational information about forestry, planting trees, managing your forest, and tips on how to harvest and sell timber.
TimberQuote's most powerful feature is a searchable database that gives timberland owners the ability to find planters, foresters, loggers, seedlings and forestry events in their area. This feature requires some basic information about the timberland owner and timberland location to function. Registration is free and involves acquiring a user name and password to gain secure access for entering information. Registration also provides timberland owners a convenient method to modify their information for future searches.
For service providers, the process of Registration is almost the same. Specific forms are included for business information and the type(s) of service offered (planter, forester, logger or mill). Again, this information is essential for matching timberland owners to service providers. To be included in the database and gain access to the search facilities, service providers must join as TimberQuote Members and pay the applicable membership fee. Additionally, it is the service providers' responsibility to ensure they are legally qualified to offer and perform their stated service(s) in their service range prior to joining. The fee charged for annual memberships may vary by the type and or number of services provided. Current fees are specified in the JOIN section and are payable by check or credit card. The membership is valid for one year unless extended by TimberQuote or by the service provider paying the applicable renewal fee. Upon receipt of the fee, TimberQuote will include the service provider's details in the database and provide a "Member" page accessible by user name and password via the TimberQuote website.
TimberQuote makes no guarantee that there are service providers in a given timberland owner's area that are capable or willing to provide the needed service. Additionally, TimberQuote can make no guarantee that timberland owners will find and/or use service providers from the TimberQuote website. However, it is paramount to the success of TimberQuote to attract and retain as many service providers as possible while informing and encouraging timberland owners about our service. TimberQuote will strive to market these services to timberland owners and service providers alike. However, we can only guarantee that a match will be made when a timberland owner's tract location falls within the service range of corresponding TimberQuote Member service providers.
TimberQuote can make no guarantees or representations regarding the skills of any service provider or the quality of the job that they may perform. It is entirely up to the user to enter into a direct contract or otherwise reach agreement with a service provider, and TimberQuote does not guarantee or warrant their performance on the job or the outcome or quality of the services performed. State and local laws typically govern a user's rights under contract made with service providers. Any dispute arising with any service provider must be addressed to the service provider directly. Agreement is hereby made to release TimberQuote and our employees and agents from any damages or claims, including consequential and incidental damages, of every kind or nature, suspected and unsuspected, known and unknown, and disclosed or undisclosed, arising out of or in any way connected with such disputes and dealings with any service provider.
PRIVACY POLICY. TimberQuote is dedicated to protecting your privacy. Upon using the TimberQuote services, you agree to disclose basic information about yourself and your timber tract (if a timberland owner) or your business (if a service provider). This information is required for the matching service to function and should not be considered intrusive. This information will be stored on our server for your convenience and will only be used in conjunction with TimberQuote services. We will not disclose your personal information to others without your permission. For service providers, only necessary contact information will be sent to timberland owners seeking your service(s). You promise that all information you provide will be accurate, current and truthful to the best of your ability. If you provide any information that is inaccurate, out dated or untruthful, or if TimberQuote has reasonable grounds to suspect that such information is inaccurate, out dated or untruthful, then TimberQuote has the right to refuse any current or future use of TimberQuote services by you. TimberQuote is not responsible for any actions caused by persons to whom users intentionally or unintentionally provided password access to their account.
USE OF TIMBERQUOTE SERVICES. It is agreed that your use of the TimberQuote website and services is for your personal use and not in competition of TimberQuote. We reserve the right to revoke your access at any time. TimberQuote shall not be liable for delay or failure in the performance of its services including such delay or failure arising from the occurrence of events beyond its reasonable control, such as, but not limited to fire, explosion, flood, storm, labor strikes, acts of God, war, embargo, bankruptcy, riot, the intervention of any governmental authority, computer viruses, or loss of server. TimberQuote shall act diligently to remedy the cause of such delay or failure and restore services to a usable condition.
USE OF TIMBERQUOTE INFORMATION. Permission to use ("Documents") such as press releases, datasheets, content, or informational items from the TimberQuote website ("Site") is granted, provided that:

Educational institutions (K-12, universities and state community colleges) may download and reproduce the Documents for distribution in the classroom. Distribution outside the classroom requires express permission from TimberQuote. Use for any other purpose is expressly prohibited by law, and may result in severe civil and criminal penalties. Documents specified above do not include the design or layout of the TimberQuote website. Elements of the TimberQuote website are protected by trade dress, trademark, unfair competition, or other laws and may not be reproduced or imitated in whole or in part without express permission from TimberQuote.
TimberQuote makes no representations about the suitability of the information and related graphics contained in the website for any purpose. All information is provided "as is" without warranty of any kind. TimberQuote hereby disclaims all warranties and conditions with regard to this information, including all implied warranties and conditions of merchantability, fitness for a particular purpose, title and non-infringement. The documents and related graphics published on this website could include technical inaccuracies or typographical errors. TimberQuote and or its authorized agents may make improvements and or changes at any time without prior notice.
LINKS. Links are provided within the TimberQuote website for your convenience. These links may take you to other sites that are not under the control of TimberQuote; therefore TimberQuote is not responsible in any way for the content, cookies, or future transmission of information by these sites. The inclusion of any link does not imply endorsement by TimberQuote.
GENERAL PROVISIONS. You acknowledge and agree that the TimberQuote website and services are provided on an "AS IS" basis without any warranty whatsoever. Your sole and exclusive remedy, and TimberQuote's sole obligation to you or any third party for any claim arising out of your use of the TimberQuote website or services, is that you are free to discontinue your use at any time. You agree to indemnify TimberQuote, its subsidiaries, affiliates, officers, employees, agents, and other partners and hold them each harmless from any and all claims or demands, including attorney's fees made by any third party due to or arising from your use of the TimberQuote website or services, or your violation of the Agreement, or arising from your violation of any rights of a third party. This Agreement will inure to the benefit of TimberQuote's successors, assigns and licensees. The failure of TimberQuote to exercise or enforce any right or provision of the Agreement shall not constitute a waiver of such right or provision. Headings are for reference purposes only and shall not be construed as a part of the Agreement. This Agreement is governed by the laws of the State of South Carolina without respect to any conflict of law principles. Should any portion of this Agreement be deemed invalid or unenforceable, such portion shall be severed and the remaining portions shall remain valid, enforceable and binding. If a court of competent jurisdiction determines by final judgment that any portion of the Agreement is too broad to be capable of enforcement, the court may modify said portion to the extent necessary to permit its enforceability, and thereafter, users shall comply with said portion as modified.
